THE ORIGINS OF THE DEVELOPMENT OF THE PUBLIC PROCUREMENT SYSTEM AS A THEORETICAL FOUNDATION FOR THE IMPLEMENTATION OF EUROPEAN STANDARDS
Abstract
This article is devoted to examining the origins and development of the public procurement system in Ukraine as a theoretical foundation for implementing European standards in the field of public procurement. The research methods are based on the application of a systematic approach, as well as methods of analysis, generalization, and systematization. The essence of the concept of public рrocurement and its main characteristics. Trends in the development of the regulatory and legal framework for public procurement in Ukraine for the period 2000–2026, and a proposal for their systematization. The analysis conducted led to the conclusion that the first and most important step in stablishing the procurement system was the adoption by the Verkhovna Rada of Ukraine in 2000 of the Law “On the Procurement of Goods, Works, and Services Using State Funds,” which laid the foundation for the modern procurement system and upon which all subsequent regulatory acts in the field of procurement are based. It is noted that the reform of the public procurement system in Ukraine was accompanied by constant changes in legislation in this area. The main goal of these changes is to shift procurement from shadow schemes to transparent, competitive tendering processes, and today these changes focus on the implementation of European standards in the field of public procurement. It is established that the laws on public procurement adopted between 2000 and 2026 were intended to align Ukrainian legislation with European Union standards. Particular attention is paid to the European integration-oriented Law “On Public Procurement,” adopted by the Verkhovna Rada in 2026. The article details the key innovations of this law, which fully harmonize Ukrainian tender procedures with European directives. А summary of the research findings allows а generalisation of the results of the genesis of the public procurement system development allows us to assert that a theoretical basis has now been created for the implementation of European standards in the field of public procurement. The obtained results be used as a theoretical basis for further scientific research.
